“Social Peace Accords”: the tightening of the Pata Medina investigated by the Justice

The case was instructed by the federal judge of Quilmes, Luis Armella, and is elevated to oral trial, in the hands of the Federal Oral Court 2 de la Plata, in charge of the judge Alejandro Esmoris. An embargo for 200 million pesos weighs on him in this case.

There are dozens of businessmen and witnesses with protected identity who testified in that file. “I also have to employ a woman who is not active on the construction site, and if I do not employ her, I cannot work. The union tells me that I have to sign the social peace agreement (…) -the witness continued- the delegates show up the first days of the work and demand a sum of money to pay them, otherwise they show up in the work and they invent things for me so that we cannot continue and have to stop it. These bribes are paid in the center or in a square, they call you and tell you where the payment is made ”.

And he said: “When I sign the social peace agreements, Juan Pablo Medina, Hugo Roldán, Carlos Vallejos, Cristian Medina and someone else who are their people is present and they tell me what the conditions are for working.”

According to another of the testimonies, Medina said: “If you do not do what I ask, I will take the work”, as a way of imposing the hiring of certain workers to companies. The businessmen of La Plata Gustavo Serafín Marín and Ricardo Alconada Magliano testified as witnesses that the delegates of the works demanded that “the personnel work slower to prolong the employment relationship.”

The accusation maintains that in order to continue with the works they were required on the one hand “monetary contributions” not contemplated in the agreement, such as contributions for “camping fee”, “end of the year bonuses”, “children’s day”, “start school “,” Christmas “,” end of work award “or the payment of salaries to employees who did not perform functions, and” retirement permits for personnel “who work in works for political events. It was also imposed, according to the file, the hiring of the companies “Abril Catering”, “Mejor que en Casa” and “Rey del Cielo” to provide catering services to the works.

Cavallo considered proven the interrelationships between the surroundings of Medina and the members of these companies, with whom they shared cars (it was corroborated through the blue cards), commercial companies, real estate, bank accounts and domiciles. The owner of Abril Catering, Juan Horacio Homs, had been identified by the prosecution as the alleged front man of the union member.

According to the judicial file, when he defended himself in this case, his lawyer, César Albarracín, who also defends the unionist Marcelo balcedo in another case, he said: “labor conquests always matter, a restriction of business profits.” Medina denied the extortions in court and said that the “Social Peace Accords” bothered employers but described it as a way to “guarantee” employees their labor rights. He also denied imposing the hiring of certain companies, he left Homs and said that another of the firms belonged to his brother-in-law’s nieces but that it had nothing to do with him.

“They put delegates from works who did not work and who were dedicated to disturbing the work by asking for things, they told the employees to work slowly so that the work was not finished and they did not let the construction foreman drive,” recalled another employer from the construction on the local leader of the Uocra.

The trade unionist, who had been arrested in 2017, was released along with his son Cristian “Puly” in February of last year, although house arrest was imposed in August of last year when he violated the prohibition imposed by the Justice to participate in union activities.

Last year he was acquitted in a case in which he was accused of “compelling the strike” to a group of masons in five works of the same company and simultaneously, in La Plata, in 2017. And he was already dismissed in another file where it was investigated whether he had threatened to “set fire to the province” if a judge ordered his arrest. When he assumed the Frente de Todos, Medina became an active plaintiff against Mauricio Macri in the case that emerged in Lomas de Zamora for alleged illegal espionage.

After the dissemination of the video about the meeting that took place on June 15, 2017 between AFI officials, Buenos Aires officials and construction businessmen, Medina said that this was how it was proven that there was a persecution against him. Today he requested the imputation of Maria Eugenia Vidal, who sought to relativize the denounced events and denied that there was a judicial table during his government.
